By accessing or using Ness ("the Service"), you agree to be bound by these Terms of Service. If you do not agree to these terms, do not use the Service.

2. Description of Service

Ness is a profile platform for musicians, artists, and content creators. The Service allows you to create a public profile with embedded content from third-party platforms (Spotify, YouTube, TikTok, Instagram), sell merchandise, promote events, and share social links.

3. Account Registration

You must create an account to use the Service. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must provide accurate and complete information during registration.

4. User Content

You retain ownership of all content you upload or create on the Service. By posting content, you grant Ness a non-exclusive, worldwide, royalty-free license to display, distribute, and promote your content as part of the Service. You are solely responsible for ensuring your content does not violate any third-party rights or applicable laws.

5. Subscriptions and Payments

Ness offers free and paid subscription tiers. Paid subscriptions are billed monthly or annually through Stripe (web) or through Apple App Store / Google Play Store (mobile apps). Subscription prices are displayed before purchase. You may cancel your subscription at any time; access continues until the end of the current billing period.

Refunds for web purchases are handled according to Stripe's refund policies. Refunds for in-app purchases are handled by Apple or Google according to their respective policies.

6. Prohibited Conduct

You agree not to:

• Use the Service for any unlawful purpose
• Upload content that infringes intellectual property rights
• Distribute malware, spam, or harmful content
• Attempt to gain unauthorized access to other accounts or systems
• Interfere with or disrupt the Service or its infrastructure
• Impersonate another person or entity
• Scrape or collect data from the Service without permission

7. Third-Party Services

The Service integrates with third-party platforms including Spotify, YouTube, TikTok, Instagram, Stripe, and authentication providers (Google, GitHub, Apple). Your use of these integrations is subject to the respective third-party terms of service. Ness is not responsible for the availability or content of third-party services.

8. Intellectual Property

The Service, including its design, code, and branding, is owned by Ness and protected by intellectual property laws. You may not copy, modify, distribute, or reverse-engineer any part of the Service without prior written consent.

9. Account Termination

You may delete your account at any time through the account settings. We reserve the right to suspend or terminate accounts that violate these terms. Upon termination, your data will be deleted in accordance with our Privacy Policy.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or secure.

11. Limitation of Liability

To the maximum extent permitted by law, Ness shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Service.
